1. ACCEPTANCE OF TERMS

By using the services of Luxe Xpress Courier ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all shipping, courier, and delivery services provided by Luxe Xpress Courier, including but not limited to barrel shipping, package delivery, and courier services to Falmouth, Montego Bay, and other service areas in Jamaica.

2. SERVICES PROVIDED

2.1 Scope of Services

Luxe Xpress Courier provides international and domestic shipping services, including:

  • Barrel and package shipping

  • Door-to-door courier services

  • Freight forwarding

  • Customs Clearance

  • Delivery to designated service areas in Jamaica

2.2 Service Areas

Our primary Pickup/ delivery areas include Falmouth and Montego Bay. Additional service areas may be available upon request and subject to additional fees.

2.3 Service Limitations

We reserve the right to refuse service for any shipment that:

  • Contains prohibited items (see Section 5)

  • Is improperly packaged

  • Lacks proper documentation

  • Poses a safety risk

  • Violates local, national, or international laws

3. RATES AND PAYMENT

3.1 Pricing

  • Current shipping rates start at $650 JMD per pound

  • Rates are subject to change without prior notice

  • Final shipping costs will be calculated based on actual weight and dimensions

  • Volumetric weight may apply to oversized packages

  • Additional fees may apply for special handling, customs clearance, or remote delivery locations

3.2 Payment Terms

  • Payment is due in full before pickup/ delivery handoff unless otherwise arranged

  • Accepted payment methods: Cash, Bank Transfer, Mobile Payment. Credit/Debit Cards... coming soon

  • A receipt will be provided for all payments

  • Unpaid balances may result in shipment delays or storage fees

3.3 Additional Fees

Additional charges may apply for:

  • Oversized or overweight items

  • Special handling requirements

  • Storage beyond the free storage period (see Section 8)

  • Delivery attempts beyond the first attempt

  • Remote or hard-to-access delivery locations

  • Customs duties, taxes, or clearance fees

4. CUSTOMER RESPONSIBILITIES

4.1 Accurate Information

Customers must provide:

  • Complete and accurate sender and recipient information

  • Valid contact phone numbers and addresses

  • Accurate description of package contents

  • Clear and unedited invoices

  • Proper customs documentation when required

4.2 Packaging Requirements

Customers and vendors are responsible for:

  • Properly securing and packaging all items

  • Using appropriate packaging materials

  • Ensuring packages can withstand normal shipping conditions

  • Labeling fragile items appropriately

4.3 Prohibited Items Disclosure

Customers must not ship prohibited items and must accurately declare all contents.

5. PROHIBITED ITEMS

Luxe Xpress Courier will NOT ship the following items:

5.1 Absolutely Prohibited

  • Illegal drugs or narcotics

  • Weapons, firearms, ammunition, or explosives

  • Hazardous materials (flammable, corrosive, toxic substances)

  • Live animals or plants

  • Perishable food items (unless pre-approved)

  • Human remains or ashes

  • Counterfeit goods or pirated materials

  • Stolen property

  • Pornographic or obscene materials

  • Items that violate Jamaican import laws

5.2 Restricted Items (Require Prior Approval)

  • Alcohol and tobacco products

  • Prescription medications (require a valid prescription)

  • High-value jewelry or precious stones

  • Electronics above certain values

  • Currency or negotiable instruments above the specified limits

5.3 Consequences

Shipping prohibited items may result in:

  • Seizure of shipment by authorities

  • Legal prosecution

  • Forfeiture of shipping fees

  • Account termination

  • Civil and criminal liability

6. LIABILITY AND INSURANCE

6.1 Limited Liability

Luxe Xpress Courier's liability is limited to:

  • Declared value of shipment (if insurance purchased), OR

  • Actual cost of shipping fees paid

6.2 Exclusions from Liability

We are NOT liable for:

  • Loss or damage to prohibited items

  • Delays due to customs, weather, natural disasters, or circumstances beyond our control

  • Loss or damage due to improper packaging by the customer or vendor

  • Loss or damage to fragile items not declared as such

  • Indirect, consequential, or special damages

  • Items without a declared value or purchased insurance

  • Delays in delivery due to incorrect address information

  • Confiscation by customs or government authorities

6.3 Insurance Options

  • Insurance is available for purchase at the time of shipping

  • Insurance must be purchased before the shipment's departure

  • Insurance claims must be filed within 48 hours of the delivery date

6.4 Claims Process

To file a claim:

  • Submit written notice within 24 hours of the delivery date

  • Provide receipt, proof of value, and photographic evidence of damage

  • Retain all original packaging materials for inspection

  • Claims are processed within 30 business days

  • We reserve the right to inspect damaged goods before settlement

7. DELIVERY TERMS

7.1 Delivery Timeframes

  • Estimated delivery times are approximate and not guaranteed

  • Delivery times begin from the date of the delivery request, once the package is at our local location

  • Delays may occur due to weather or other factors beyond our control

7.2 Delivery Attempts

  • We will make one delivery attempt to the specified address

  • The recipient must be available to receive and sign for packages

  • Photo ID may be required for delivery

  • Additional fees apply for re-delivery attempts

7.3 Failed Delivery

If delivery cannot be completed:

  • The package will be held at our facility for 14 days

  • Storage fees may apply after 14 days

  • Customer will be notified via phone, email, or SMS

  • Unclaimed packages after 30 days may be considered abandoned

7.4 Delivery Confirmation

  • Signature may be required upon delivery

  • Delivery is confirmed when signed by the recipient or an authorized person

  • Photographs may be taken as proof of delivery

8. STORAGE AND HOLDING

8.1 Storage Period

  • Free storage is provided for 14 days after arrival at the destination

  • Storage fees of 100 JMD per day apply after the free period

  • The maximum storage period is 30 days

8.2 Abandoned Packages

Packages unclaimed after 30 days:

  • Will be considered abandoned

  • Will be disposed of or sold to recover storage fees

  • Customer remains liable for all outstanding fees

9. CUSTOMS AND DUTIES

9.1 Customs Clearance

  • Customer is responsible for all customs duties, taxes, and fees

  • We assist with customs clearance, but do not guarantee clearance

9.2 Customs Delays

  • We are not liable for delays due to customs inspection or clearance

  • Packages may be opened and inspected by customs authorities

9.3 Prohibited Imports

  • The customer is responsible for knowing Jamaican import restrictions

  • Items seized by customs will not be refunded and will not be our responsibility

10. TRACKING AND NOTIFICATIONS

10.1 Tracking Services

  • Tracking will be provided for all shipments

  • Tracking information is updated periodically within the portal

  • Tracking accuracy is not guaranteed, as delays may occur

10.2 Notifications

  • We will attempt to notify customers via phone, email, or WhatsApp

  • Customer is responsible for providing accurate contact information

  • We are not liable for failed notifications due to incorrect information

11. CANCELLATIONS AND REFUNDS

11.1 Cancellation/ Refund Policy

  • No refunds or cancellations are offered once the package is delivered to our US warehouse

12. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

  • Natural disasters (hurricanes, earthquakes, floods)

  • War, terrorism, or civil unrest

  • Government actions or restrictions

  • Airline delays

  • Strikes or labor disputes

  • Pandemics or public health emergencies

  • Severe weather conditions

  • Equipment failures or accidents

13. PRIVACY AND DATA PROTECTION

13.1 Information Collection

We collect customer information, including:

  • Name, address, phone number, email, TRN

  • Package details and contents

  • Payment information

  • Delivery confirmation data

13.2 Use of Information

Customer information is used for:

  • Processing and delivering shipments

  • Customer service and communication

  • Billing and payment processing

  • Legal compliance and record-keeping

13.3 Information Sharing

We do not sell customer information. We may share information with:

  • Shipping partners and carriers

  • Customs and government authorities, as required by law

  • Payment processors

  • Legal authorities, when required

13.4 Data Security

We implement reasonable security measures to protect customer information, but we cannot guarantee absolute security.

14. DISPUTE RESOLUTION

14.1 Governing Law

These terms are governed by the laws of Jamaica.

14.2 Dispute Resolution Process

In the event of a dispute:

  1. Contact our customer service team for resolution at [email protected]

  2. If unresolved, mediation may be pursued

  3. Legal action must be filed in the courts of Jamaica

14.3 Limitation Period

Claims must be filed within 24 hours of the incident or delivery date.

15. MODIFICATIONS TO TERMS

15.1 Right to Modify

Luxe Xpress Courier reserves the right to modify these Terms and Conditions at any time without prior notice.

15.2 Notification

Updated terms will be posted on our website and/or at our physical location with the effective date.

15.3 Continued Use

Continued use of our services after modifications constitutes acceptance of the updated terms.

16. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Luxe Xpress Courier and the Customer, superseding any prior agreements or understandings.

  • You have read and understood these Terms and Conditions

  • You agree to be bound by these terms

  • You accept responsibility for compliance with all applicable laws

  • You understand our liability limitations
