Effective Date: August 2026
Last Updated: August 2026

These Terms & Conditions govern the use of shipping, courier, freight, package forwarding, pickup, delivery, and related services provided by Luxe Xpress Courier (“Luxe Xpress Courier,” “LXC,” “we,” “our,” or “us”).

By creating an account, delivering or directing goods to one of our overseas addresses, requesting shipment or delivery, or otherwise using Luxe Xpress Courier services, you acknowledge that you have read and agree to these Terms.

These Terms apply only to Luxe Xpress Courier services. Luxe Xpress Fulfillment Hub and purchases made through the Luxe Xpress Shop or SoftLux Co. are governed by separate terms.

1. Services

Luxe Xpress Courier provides international shipping and related services, which may include:

  • USA and China shipping addresses
  • Air freight
  • Sea freight
  • Barrel shipping
  • Package forwarding
  • Freight services
  • Customs processing assistance
  • Package tracking
  • Pickup
  • Local and islandwide delivery
  • Other shipping services advertised by Luxe Xpress from time to time

Available services may vary depending on the origin, destination, item type, size, weight, customs requirements, carrier availability, and other operational factors.

Providing an overseas shipping address does not guarantee that every product may legally or safely be shipped.

2. Customer Accounts

Customers are responsible for providing complete, accurate, and current information when creating and maintaining an account.

Information requested may include:

  • Full name
  • Phone number
  • Email address
  • Address
  • TRN
  • Government-issued identification where required
  • Other information reasonably required for shipping or customs processing

Customers must keep their login credentials secure and are responsible for activity conducted through their accounts unless unauthorized access is promptly reported to us.

Accounts may not be transferred or used to facilitate illegal, fraudulent, or prohibited activity.

3. Overseas Shipping Addresses

Registered customers may be provided with USA and/or China shipping addresses for use with eligible purchases.

Customers must:

  • Enter the shipping address exactly as provided
  • Include their assigned customer/account identifier where required
  • Ensure merchants and suppliers correctly address packages
  • Provide accurate package and purchase information

Luxe Xpress is not responsible for delays, losses, or misidentification caused by incorrect or incomplete addressing by the customer, merchant, sender, or supplier.

Package consolidation is not included as a standard Luxe Xpress Courier service unless expressly agreed in writing for a particular shipment.

4. Rates and Charges

Shipping rates and fees are published through our website, customer portal, quotation, invoice, or other official Luxe Xpress communication.

Rates may vary based on:

  • Origin
  • Weight
  • Dimensions
  • Volumetric weight
  • Shipping method
  • Commodity
  • Customs requirements
  • Special handling
  • Delivery destination
  • Other applicable charges

Published shipping-calculator amounts are estimates unless specifically stated otherwise. Final charges are determined using the shipment details recorded during processing.

Rates and fees may change. Where practical, current rates will be made available through our website, portal, or official communication channels.

Additional charges may apply for oversized, bulky, heavy, restricted, specially handled, stored, customs-processed, or remotely delivered shipments.

5. Payment

Unless otherwise agreed in writing, all outstanding charges must be paid before a package is released for pickup or delivery.

Charges may include:

  • Freight
  • Processing
  • Customs duties and taxes
  • Handling
  • Storage
  • Delivery
  • Insurance
  • Special handling
  • Other applicable fees

Accepted payment methods are those currently offered by Luxe Xpress.

A package may be held while an outstanding balance remains unpaid.

6. Customer Responsibility for Purchases and Documentation

The customer is responsible for:

  • Ordering the correct product
  • Ensuring the item is legally importable
  • Providing accurate descriptions and values
  • Providing clear, complete, and unaltered invoices or receipts
  • Obtaining permits, licences, certificates, or approvals where required
  • Providing information requested for customs processing
  • Ensuring the merchant or supplier packages the goods adequately

Invoices should be uploaded as soon as reasonably possible and before customs processing.

Missing Invoices

If a valid invoice or other satisfactory evidence of value is not provided before customs processing, Luxe Xpress may be required to submit a value based on the information available for processing purposes.

The Jamaica Customs Agency or other relevant authority has final authority over customs valuation and assessment.

Any duties, taxes, penalties, processing charges, or other customs-related fees assessed must be paid before the shipment is released where applicable.

7. Customs, Duties and Taxes

Customers are responsible for all applicable customs duties, taxes, permits, assessments, inspections, and government charges associated with their shipments.

Luxe Xpress may assist with customs processing but:

  • Does not control Jamaica Customs
  • Cannot guarantee customs clearance
  • Cannot guarantee the amount of customs duties or taxes
  • Cannot guarantee that Customs will accept a customer's declared value
  • Cannot guarantee customs-processing time

Packages may be inspected, opened, detained, reassessed, seized, or otherwise handled by customs or another government authority.

Luxe Xpress is not responsible for delays caused by lawful government inspection or processing.

8. Restricted and Prohibited Goods

Customers must not ship goods prohibited by applicable Jamaican, foreign, carrier, aviation, maritime, postal, or customs laws and regulations.

Prohibited Goods

Examples may include:

  • Illegal drugs and narcotics
  • Certain weapons, ammunition, or explosives
  • Stolen property
  • Counterfeit or unlawful goods
  • Certain hazardous or dangerous materials
  • Goods prohibited from importation into Jamaica
  • Other items Luxe Xpress or its carriers cannot lawfully transport

Restricted / Permit-Required Goods

Some goods may be legally imported only with permits, licences, approvals, prescriptions, certificates, or other documentation.

Customers are responsible for obtaining all required approvals before shipping where applicable.

Luxe Xpress may refuse, hold, return, surrender, or otherwise decline to process goods that are unsafe, undocumented, prohibited, restricted without appropriate approval, or inconsistent with carrier requirements.

Any costs resulting from prohibited or improperly documented goods remain the customer's responsibility to the extent permitted by law.

9. Packaging and Condition of Goods

The sender, merchant, supplier, or customer is responsible for ensuring goods are appropriately packaged for ordinary international transportation.

Luxe Xpress is not responsible for damage caused primarily by:

  • Inadequate merchant packaging
  • Existing product defects
  • Improper internal packaging
  • Ordinary wear caused by inadequate protection
  • Leakage from inadequately sealed products

Where visible external damage is identified during processing, Luxe Xpress may document the condition of the shipment.

10. Tracking and Notifications

Tracking information may be provided through the customer portal, email, WhatsApp, SMS, or other communication channels.

Tracking events are informational and may not always update in real time.

Customers are responsible for maintaining accurate contact information.

Failure to receive a notification does not eliminate outstanding fees or other customer responsibilities.

11. Transit Times

All stated transit times are estimates unless expressly guaranteed in writing.

Transit may be affected by:

  • Airlines
  • Shipping lines
  • Customs
  • Weather
  • Port congestion
  • Supplier delays
  • Public holidays
  • Government action
  • Carrier operations
  • Events beyond Luxe Xpress's reasonable control

A delay does not automatically entitle the customer to a refund.

12. Pickup

Packages may be collected from designated Luxe Xpress pickup locations once the customer has been notified that the package is ready and all outstanding charges have been paid.

We may request:

  • Valid identification
  • Account verification
  • Proof of payment
  • Authorization for third-party collection

A package released to a person properly authorized by the account holder will be considered collected by the customer.

13. Delivery

Delivery may be available to selected areas directly or through third-party delivery partners.

Delivery fees and availability depend on destination and service type.

Customers must provide an accurate delivery address and ensure that the recipient can receive the shipment.

Additional charges may apply for:

  • Incorrect addresses
  • Unsuccessful delivery attempts
  • Redelivery
  • Changes after dispatch
  • Remote destinations

Proof of delivery may include a signature, photograph, electronic confirmation, recipient name, or delivery-partner record.

14. Storage and Unclaimed Packages

Customers must collect or arrange delivery of packages within the timeframe communicated by Luxe Xpress.

Free-storage periods and subsequent storage fees may be published separately and may change from time to time.

Packages remaining unclaimed for an extended period may be treated as abandoned after reasonable attempts to contact the customer and subject to applicable law.

Where legally permitted, abandoned goods may be disposed of, returned, sold, or otherwise dealt with to recover outstanding shipping, customs, storage, or handling charges.

15. Insurance and Package Protection

Optional shipment protection or insurance may be offered for eligible shipments.

Coverage:

  • Must generally be arranged before the relevant shipment departs
  • May be subject to exclusions
  • May require proof of purchase and value
  • Does not necessarily cover every type of loss or damage

The specific insurance or protection terms communicated at the time of purchase will apply.

16. Loss, Damage and Claims

Customers should inspect packages promptly upon receipt.

Claims for visible loss or damage should be submitted within 48 hours of pickup or delivery, unless a different period is stated in the applicable insurance terms.

A claim may require:

  • Proof of purchase
  • Original invoice
  • Photographs
  • Packaging
  • Tracking details
  • Description of loss or damage
  • Other reasonable supporting evidence

Submission of a claim does not guarantee approval.

Where a third-party carrier or insurer is responsible for determining a claim, its applicable claims procedure may also apply.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Luxe Xpress will not be responsible for indirect, incidental, consequential, special, or purely economic losses arising from a shipment.

We are not responsible for loss or damage caused by circumstances outside our reasonable control, including customs action, government seizure, force majeure, inadequate supplier packaging, prohibited goods, undeclared goods, inaccurate information supplied by the customer, or ordinary carrier delays.

Nothing in these Terms is intended to exclude or restrict rights or remedies that cannot lawfully be excluded under Jamaican law. Jamaica's Consumer Protection Act provides protections in relation to the supply of goods and services.

Where Luxe Xpress accepts liability for a shipment, the applicable amount will be determined having regard to the circumstances, proof of value, applicable insurance, third-party carrier terms, and rights available under law.

18. Cancellations and Refunds

Once a package has been delivered to, accepted at, or processed through an overseas Luxe Xpress facility or shipping partner, shipping-related services may no longer be cancellable.

Charges already incurred on behalf of a customer are non-refundable unless otherwise required by law.

Approved refunds, credits, or adjustments will be determined according to the circumstances of the transaction.

19. Account Suspension or Termination

Luxe Xpress may suspend, restrict, or terminate an account where reasonably necessary because of:

  • Fraud
  • Non-payment
  • Abuse
  • Threatening conduct
  • Illegal activity
  • Repeated policy violations
  • Prohibited shipments
  • Material misrepresentation
  • Risk to our staff, systems, carriers, customers, or business

Outstanding obligations survive account closure.

20. Privacy

Personal information is handled according to the Luxe Xpress Privacy Policy, which applies across Luxe Xpress Courier, Luxe Xpress Fulfillment Hub, the Shop, and associated digital platforms.

Jamaica's Office of the Information Commissioner requires data controllers to comply with the Data Protection Act's data-protection standards, including requirements concerning lawful processing, security, retention, data-subject rights, and international transfers.

21. Force Majeure

Luxe Xpress is not responsible for delay or failure caused by events outside its reasonable control, including:

  • Hurricanes
  • Floods
  • Earthquakes
  • Severe weather
  • War
  • Civil unrest
  • Government action
  • Customs action
  • Strikes
  • Carrier disruption
  • Airline or shipping-line disruption
  • Port closures
  • Public-health emergencies
  • Major technology or infrastructure outages

22. Changes to Services or Terms

We may update these Terms periodically.

The current version will be published on our website or platform with the revised date.

Material changes may also be communicated through reasonable electronic means where appropriate.

Continued use of Luxe Xpress Courier after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Electronic transactions and communications are recognized within Jamaica's legal framework under the Electronic Transactions Act.

23. Governing Law and Disputes

These Terms are governed by the laws of Jamaica.

Customers should first contact Luxe Xpress to attempt to resolve a dispute.

Where a dispute cannot be resolved informally, the parties may pursue any lawful dispute-resolution or court process available in Jamaica.

Nothing in this section prevents a consumer from exercising rights available under applicable consumer-protection law.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
